Judge dismisses preposterous Anna Nicole Smith gay sex libel claim
Claims that Anna Nicole Smith watched a videotape of her lawyer and boyfriend having gay sex have been branded “preposterous” by a judge.
The allegations are at the heart of a $60m libel suit filed by Smith’s former lawyer, Howard K Stern, against TV reporter and author Rita Cosby.
Cosby claimed in her book, Blonde Ambition: The Untold Story Behind Anna Nicole Smith’s Death, that Howard K. Sternand Smith’s lover, Larry Birkhead, were once caught having sex at a party in Los Angeles.
Both Howard K. Stern and Birkhead claimed to be the father of Smith’s daughter Dannielynn, after the former Playboy model died, with DNA evidence eventually proving it was Birkhead.
"One point I find troubling is that Anna Nicole Smith used to entertain herself by watching this supposed videotape," said Manhattan federal Judge Denny Chin during arguments in the lawsuit.
"On the face of it, this story seems preposterous."
Stern has claimed that 19 passages in Cosby’s book libel him, with his lawyer Lin Wood alleging that Cosby admitted in a deposition that the videotape does not exit.
Wood argues that publisher Hachette Book Group USA rushed the book into print in time for Dannielynn’s first birthday.
However, Cosby’s lawyers argue that Stern is “libel-proof” because his reputation “was in tatters” before the publication of Cosby’s book in 2007.
Anna Nicole Smith died in 2007, at the age of 39, from an accidental drugs overdose.
